These Terms and Conditions govern access to and use of ginkip.com by registered businesses requesting managed urgent overseas delivery services. By registering an account, submitting a request, accepting a quotation, uploading documents, or using the platform, your company agrees to these Terms.
1. Parties and Service Model
ginkip.com operates as a managed service provider for urgent overseas delivery requests. The customer contracts with ginkip.com only. ginkip.com may review, coordinate, assign, substitute, manage, and pay fulfilment resources at its own discretion.
The platform is not an open public transporter marketplace. Customers do not choose, contact, contract with, supervise, or pay individual fulfilment resources through the platform.
2. Business Account Registration
Accounts are available to businesses and organisations. Registration requires a company email address and accurate company information, including company name, identification number where applicable, address, contact person, billing email, and contact number.
ginkip.com may approve, reject, suspend, or request more information for any registration. Account approval does not guarantee that any specific delivery request will be accepted.
3. Authority to Use the Platform
You represent that you are authorised to register the company, submit delivery requests, upload shipment documents, accept quotations, make payment arrangements, and provide declarations on behalf of the company.
4. Delivery Requests Are Not Automatic Acceptance
A submitted order is a request for review. ginkip.com accepts an order only after operational review, quotation, customer acceptance, and payment confirmation or approved credit arrangement. ginkip.com may decline a request for operational, compliance, safety, timing, documentation, payment, or business reasons.
5. Shipment Information and Documents
Your company must provide complete and accurate information, including origin, destination, addresses, deadlines, receiver details, goods description, quantity, declared value, weight, dimensions, and all relevant documents or photos.
Documents may include commercial invoices, packing lists, permits, authorisations, package photos, and any other records required to evaluate or perform the service. ginkip.com may request additional information at any time.
6. Prohibited, Restricted, and Regulated Goods
Your company must not submit unlawful, prohibited, misdeclared, unsafe, or restricted goods unless fully disclosed and accepted in writing by ginkip.com. Goods involving batteries, dangerous goods, controlled goods, fragile items, perishables, medical items, high-value items, or regulated products must be clearly declared before quotation acceptance.
ginkip.com may reject, cancel, hold, return, or report a shipment if it believes the shipment may violate law, regulation, carrier rules, aviation/security requirements, customs requirements, or platform policy.
7. Compliance Responsibilities
Your company remains responsible for export/import compliance, customs declarations, sanctions screening, permits, licences, taxes, duties, lawful content, accurate values, and authority to ship the goods. ginkip.com may assist operationally, but such assistance does not transfer legal responsibility from your company.
8. Quotations and Pricing
Quotations are all-in customer-facing service fees unless stated otherwise. A quotation may include service coordination, urgent handling, delivery management, and expected operational costs, but internal cost breakdowns and platform margins are confidential.
Quotations may expire, be withdrawn, or be revised if shipment details, deadlines, documents, availability, compliance requirements, destination conditions, or operational assumptions change.
9. Payment and Credit Terms
Unless approved credit terms apply, payment is required before an order is confirmed. Manual payment proof may be reviewed before payment is marked received. ginkip.com may delay, pause, or cancel service if payment is not received or cannot be verified.
Where credit terms are approved, your company must pay within the agreed period and remain within any credit limit. ginkip.com may suspend posting access or hold orders for overdue amounts.
10. Cancellation, Rejection, and Changes
Changes to route, deadlines, goods, receiver details, documents, or service requirements may require re-review and re-quotation. Cancellation after acceptance may be subject to costs already incurred or committed by ginkip.com.
ginkip.com may reject or cancel an order if information is incomplete, inaccurate, misleading, late, non-compliant, unsafe, unpaid, or commercially impractical.
11. Managed Fulfilment and Confidentiality
Fulfilment resources, routes, travel plans, accommodation, internal assignments, internal notes, internal costs, payout amounts, identity documents, phone numbers, and personal details of fulfilment resources are confidential platform information.
Your company must not request, infer, publish, contact, approach, solicit, or attempt to contract directly with any fulfilment resource introduced, used, or managed by ginkip.com.
12. Customer Portal, Statuses, and Proof of Delivery
The customer portal shows customer-facing service statuses, quotations, payment status, milestones, documents, and partner-visible proof of delivery. Statuses are operational updates and may not reflect every internal step.
Proof of delivery may include photos, receiver details, signatures, timestamps, and other partner-visible proof records. ginkip.com may withhold or redact proof where necessary for privacy, safety, legal, or confidentiality reasons.
13. File Uploads and Records
Your company is responsible for ensuring uploaded files are accurate, lawful, virus-free, and appropriate for the requested service. ginkip.com may retain documents, audit logs, payment proofs, status logs, and delivery proofs for operational, legal, compliance, accounting, and security purposes.
14. Account Security
Your company is responsible for maintaining secure passwords, authorised users, accurate contact details, and timely notification of suspected unauthorised access. Actions performed through an account may be treated as authorised by the registered company.
15. Service Levels and Time Estimates
Any response target, pickup estimate, delivery estimate, or milestone timing is an operational target, not a guarantee, unless expressly agreed in writing. Urgent overseas delivery may be affected by customs, carrier disruption, immigration, weather, airport operations, security checks, government action, payment delays, document issues, and other events outside ginkip.com's control.
16. Liability Limits
To the maximum extent permitted by law, ginkip.com is not liable for indirect, consequential, special, punitive, or loss-of-profit damages. ginkip.com's aggregate liability for an order is limited to the amount paid to ginkip.com for that order, unless a different written agreement applies.
Your company is responsible for arranging insurance where shipment value, urgency, or risk requires it. Declared value does not automatically create insurance coverage.
17. Indemnity
Your company agrees to indemnify ginkip.com against claims, penalties, losses, costs, damages, or expenses arising from inaccurate information, unlawful goods, missing permits, customs or regulatory breaches, misuse of the platform, unauthorised submissions, or breach of these Terms.
18. Suspension and Termination
ginkip.com may suspend or terminate account access for non-payment, suspected fraud, security concerns, repeated inaccurate submissions, compliance risk, abusive conduct, attempts to bypass the platform, or breach of these Terms.
19. Privacy and Data Protection
Personal data and business information are handled according to our Privacy Policy. By using the platform, your company confirms that it has the authority to provide personal data of employees, receivers, representatives, and other contacts needed for the service.
20. Changes to These Terms
ginkip.com may update these Terms from time to time. Continued use of the platform after changes are published means your company accepts the updated Terms.
